Canary Patterns is operated by a sole proprietor in Washington State, USA. Products currently include digital downloads and consulting services. References to "the site" in these Terms refer to canarypatterns.com and any associated pages or services.
2. Eligibility
By using this site, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Thinking Forge products are intended for professional use. We do not knowingly permit use of our site or products by anyone under the age of 16.
3. Digital Products — License and Delivery
Delivery
Upon completing a purchase, you will receive access to the purchased digital product via a download link on the post-purchase confirmation page. You are responsible for downloading and saving your files promptly. We are not obligated to store your purchased files indefinitely or to re-deliver them at a later date, though we will make reasonable efforts to assist in the event of a technical delivery failure.
License grant
Upon purchase, Thinking Forge grants you a limited, personal, non-exclusive, non-transferable license to use the purchased digital product for your own professional work. This license does not include the right to:
Resell, sublicense, or redistribute the product to any third party, whether for compensation or free of charge.
Publish, share, or post the product publicly (including on websites, social platforms, or in training materials distributed to others).
Use the product to create a competing product or service.
Remove or alter any copyright notices, branding, or attribution contained in the product.
Team or organizational use
The standard license covers a single user. If you wish to use Thinking Forge products across a team or organization, please contact us at hello@canarypatterns.com to discuss a multi-seat or organizational license.
4. Refund Policy
All sales of digital products are final. Because digital products are delivered immediately upon purchase and cannot be "returned," we do not offer refunds as a matter of standard policy.
If you experience a verified technical failure that prevents you from accessing or downloading your purchased product, please contact us at hello@canarypatterns.com within 7 days of purchase. We will work to resolve the issue by re-delivering the product. Refunds will only be considered in cases where a technical failure cannot be remedied.
We do not offer refunds based on dissatisfaction with AI-generated outputs, as results vary depending on inputs, tools used, and individual context — factors outside our control.
5. Intellectual Property
All content on canarypatterns.com — including but not limited to text, design, graphics, frameworks, prompt structures, methodologies, branding, and the Forge Method — is the intellectual property of Canary Patterns and Thinking Forge and is protected by applicable copyright, trademark, and intellectual property laws.
You may not reproduce, copy, modify, create derivative works from, distribute, publicly display, or otherwise exploit any part of this site or its products without our prior written permission, except as expressly permitted under the license granted upon purchase.

6. Use of AI Tools
Thinking Forge products are designed to be used with third-party AI tools, including ChatGPT (OpenAI) and Claude (Anthropic). Your use of those tools is subject to their respective terms of service and usage policies. Thinking Forge is not affiliated with, endorsed by, or a partner of OpenAI or Anthropic.
We make no warranties regarding the quality, accuracy, or suitability of outputs generated by AI tools when used in conjunction with our prompts. AI-generated content can be inaccurate, incomplete, biased, or inappropriate for a given context. You are solely responsible for reviewing, validating, and taking responsibility for any AI-generated content before using it in a professional, organizational, or public context.
Use of Thinking Forge products in ways that violate the terms of service of any AI platform is prohibited.
7. Acceptable Use
By using this site and its products, you agree not to:

We reserve the right to terminate your access to the site and its products if we determine, at our sole discretion, that you have violated these acceptable use provisions.
8. User-Provided Content
If you contact us by email or submit content to us in any form, you represent that you have the right to share that content and that it does not violate any third-party rights. You grant us a limited right to use any feedback or suggestions you provide for the purpose of improving our products and services, without any obligation to compensate you.
We are not responsible for any content or information you choose to input into third-party AI tools when using our prompts.
9. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Thinking Forge products, the site, and all content and services are provided "as is" and "as available" without warranties of any kind, express or implied.
We expressly disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

The site will be uninterrupted, error-free, or free from viruses or other harmful components.
Any AI-generated outputs produced using our prompts will be accurate, complete, or appropriate for your specific use case.

Some jurisdictions do not allow the exclusion of implied warranties. If you are in such a jurisdiction, some of the above exclusions may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Thinking Forge and its owner shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the site or its products — including but not limited to loss of revenue, loss of profits, loss of data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claims arising out of or related to these Terms or your use of the site, regardless of the form of action, shall not exceed the amount you paid to Canary Patterns in the twelve (12) months preceding the event giving rise to the claim, or $50 USD, whichever is greater.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. If you are in such a jurisdiction, some of the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Thinking Forge and its owner from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the site or its products; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any AI-generated content you create, distribute, or act upon using our products.
12. Dispute Resolution and Arbitration
Informal resolution first
Before initiating any formal legal proceedings, you agree to contact us at hello@canarypatterns.com and give us 30 days to attempt to resolve the dispute informally. Most concerns can be resolved quickly this way.
Binding arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site — including questions of arbitrability — shall be resolved by binding individual arbitration administered by a mutually agreed arbitration service under its then-current rules, rather than in court.
The arbitration shall be conducted in English, in Washington State (or remotely by mutual agreement). The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver
You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. You waive any right to bring or participate in a class action, collective action, or representative proceeding against Canary Patterns.
Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or other irreparable harm.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Washington State.
14. Third-Party Links
The site may contain links to third-party websites or services. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party site. Accessing third-party links is at your own risk.
15. Modifications to the Site or Terms
